Medical Bills
and Liens

Many times, one of the biggest things our clients are concerned about are the medical bills - which sometimes can even be much more than the settlement amount in a case! Between bills, liens (such as Medicare), healthcare subrogation, and other line items, it often appears that you've gone through all of this for no reason at all!
Not to worry, however - our firm routinely negotiates with private healthcare providers, governmental entities, subrogation firms, and other claimants to reduce (and, in many instances, entirely eliminate) these claims. You paid for your health insurance - it's simply unfair that you would have to pay them back for doing the job you paid them for in the first place!
Fees for Our
Representation

For injury cases, WE REPRESENT OUR CLIENTS WITHOUT ANY UP-FRONT LEGAL FEES.
Instead of demanding a flat fee up-front or billing you hourly for services, we don't get paid unless and until you get paid. In fact, we're basically the last people who get paid! We also don't charge extraordinary fees (i.e., 40% or more) like some firms do, but we are not "bargain basement" hacks who charge extremely low fees either. Our general fee is one-third of the amount recovered, and we put everything in writing so that we're all on the same page.
Here's an example of how it works:

We're able to settle your case for a million bucks (yahoo!)

You have outstanding medical bills and liens of $500,000 (dammit!)

However, we are able to negotiate these bills down to $50,000 (woo woo!)

There are some other costs and expenses (e.g., investigators, medical record fees, service costs, etc.) that we've paid out of our pockets on your behalf, say, $5,000
-
Our agreed-upon fees for representation are a third
After everything is paid - fees, costs, expenses, medical bills, etc. - you would receive $611,666.67...and the best part is that (for you at least) this is generally tax free since it's compensatory in nature!
Granted, that is a fictional example (clearly not every case settles for a million dollars), and for actual tax questions you should talk to an accountant. But that's a basic way things work in general with our fees - and, really, most injury firms' fees. We just happen to be the injury firm that works for motorcyclists.

Many firms require clients to wait weeks (and sometimes even months) after settlement to actually receive their compensation. This is generally well-intentioned, and has to do with payment for liens, subrogation, medical expenses, and so on. However, the effect of this is to leave you without money for much longer than you have probably anticipated.
In contrast to that, OUR GOAL IS TO HAVE MONEY IN YOUR HANDS WITHIN 72 HOURS OF THE INSURANCE CHECK CLEARING as much as possible. If you owe money to others, we will withhold that amount - and still attempt to negotiate the bills down as far as possible, and then send you the rest. But there's no reason for you to have to wait to receive any payment at all - after all, you're the injured person; the hospital is not!
We are also often able to assist you in obtaining pre-settlement funding, which means that you would receive money right now which will be paid back after the case has settled. If you are interested in this type of arrangement, we are able to guide you and assist you in finding the right funding. And don't worry - we don't receive any money or have any financial ties to any pre-settlement funding company - it's just a way for our clients to obtain financial assistance, if needed, before the case is over!

Our attorneys are licensed to provide services in Pennsylvania, as well as Federal Courts. Although we are sometimes able to serve clients in other courts (with permission known as "pro hac vice"), if a case has to go to court we are generally limited to the jurisdictions in which we are licensed.

Bio
Mr. Daffner is the founding member of the firm, and serves as the Managing Attorney. He has personally handled thousands of legal matters in a wide variety of jurisdictions, and is a highly-respected member of the Bar, having successfully represented clients in numerous high-profile cases over the years.
In addition to his trial practice, Mr. Daffner serves as a specially-appointed Arbitrator in the Civil Division of the Court of Common Pleas, as well as in the United States District Court. He is a sought-after instructor for Continuing Legal Education courses, and is the author of several books and teaching materials.
In addition, Mr. Daffner is currently serving his fifth term as an elected County Committeeman, and has been a candidate for Judge of the Court of Common Pleas of Allegheny County.
The recipient of a variety of honors and commendations, Mr. Daffner has been repeatedly selected as a Pennsylvania "Super Lawyer," placing him in the top 5% of attorneys in Pennsylvania, one of the Top 100 Trial Lawyers by the National Trial Lawyers, included among the Best Attorneys of America, and honored with the Martindale-Hubbell Client Service Award. Some Statistics
There are approximately 8.8 million motorcycles registered in the United States, about 341,976 of which are registered in Pennsylvania, making it the 7th highest population of motorcycles/motorcyclists in the nation. This number, of course, doesn't include the millions of unregistered bikes (probably 2 to 1 on that), or the fact that many - if not most - bikers do not actually have a motorcycle-specific license.
According to the National Highway Traffic Safety Administration, 6,335 motorcyclists were killed in crashes last year, representing 15% of all traffic fatalities. 74% of motorcycle riders who died in crashes were wearing DOT-compliant helmets, and the fatality rate for motorcycles is nearly 29 times higher than for passenger vehicles per mile traveled!
During that same time period, over 82,000 motorcyclists were injured (but not fatally) in accidents!
Most Common Causes of Motorcycle Accidents

Alcohol: In 2023, 41 percent of motorcycle riders who died in single-vehicle crashes had a blood alcohol concentration (BAC) of .08 or higher, meaning they were alcohol-impaired.

Fixed objects: Many motorcycle accidents don’t involve other moving objects like cars. Rather, they involve collisions with fixed objects, like hitting parked cars.

Lack of awareness: Many motorcycle accidents occur because drivers of other vehicles fail to detect the presence of a motorcycle, particularly when turning or changing lanes.

Lane splitting: Riding down the middle of the lane causes a significant percentage of accidents.

Low visibility: Low visibility is a huge issue for motorcyclists, and contributes to many accidents.

Speeding: Speeding was involved in 35 percent of motorcycle crashes in 2022.
